Federal Judge Vacates National Eviction Moratorium; NY Extends

Today, Judge Dabney Friedrich of the DC Federal District Court vacated the CDC nationwide eviction moratorium that has been in place since September 2020. The court found the CDC overstepped its statutory authority in using the Public Health Service Act to prevent landlords from evicting tenants. While other federal courts have held the moratorium exceeds the CDC’s statutory authority or is otherwise unconstitutional, this ruling is the first to actually strike down the moratorium. The opinion noted vacatur of the rule was the appropriate remedy rather than only applying the result to the plaintiffs. Click here for more background on the moratorium.
